Terms of Service

By creating an account, accessing, or using NativSpeaker, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the service.

Age requirement: You must be at least 13 years oldto use NativSpeaker. By using the service, you confirm you meet this requirement. If you are under 18, you confirm you have your parent or guardian's permission.

Updates to these Terms: We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

NativSpeaker is an educational language learning platform that helps users acquire foreign languages through the "shadowing" technique — listening to and speaking along with native-speaker video content.

The service includes:

• A synchronised teleprompter that displays captions in time with video playback
• Real-time translation of captions powered by DeepL
• Word-by-word pronunciation guides and breakdowns
• A personal vocabulary bank with spaced-repetition review
• Progress tracking, daily streaks, and learning analytics
• Section crop and loop tools (Pro tier)

Caption processing: NativSpeaker accesses publicly available caption and subtitle data from third-party video platforms solely for educational language learning purposes. Caption data is processed in real time and is not stored, redistributed, or monetised. We process only text — we never download, host, or proxy video or audio files.

No affiliation:NativSpeaker is an independent tool. We are not affiliated with TikTok, YouTube, Instagram, or any other content platform. Users are responsible for ensuring their own use of those platforms complies with those platforms' terms of service.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where practicable.

You agree that you will not:

• Use NativSpeaker for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or use automated tools to access the service
• Reverse-engineer, decompile, or attempt to extract the source code of NativSpeaker
• Share, sell, or transfer your account credentials to any other person
• Use the service to reproduce, redistribute, or make available third-party caption text outside of your personal language learning
• Use the service to infringe any intellectual property or proprietary rights of any third party
• Attempt to bypass, disable, or interfere with any security features of the service
• Transmit any harmful, offensive, or disruptive code or content
• Impersonate any person or entity or falsely represent your affiliation
• Use the service in any way that could damage, disable, or impair NativSpeaker's infrastructure

Processed caption text may only be used for your personal, non-commercial language learning. Any other use — including republishing, training AI models, or commercial exploitation — is strictly prohibited.

NativSpeaker may access publicly available caption and subtitle data from third-party video platforms to power the language learning teleprompter. In doing so:

• We do not host, store, or distribute any third-party video or audio content
• All video content remains on the original platform and is streamed directly from it
• Original content creators retain all rights to their content
• We process only text captions — never video or audio files
• Caption data retrieved for a session is not retained beyond that session
• We do not monetise third-party caption content directly

Users are solely responsible for ensuring their use of third-party platforms alongside NativSpeaker complies with those platforms' terms of service. If a third-party platform changes its policies or APIs and captions become unavailable, NativSpeaker is not liable for any resulting interruption to the service.

The Free tier includes:

• 5 practice sessions per day
• Teleprompter with real-time translation
• Basic word breakdown

The Free tier does not include:

• Vocabulary bank and spaced-repetition review
• Full progress tracking and analytics
• Section crop and loop tools
• Weekly progress email reports
• Vocabulary export (CSV / PDF)

We reserve the right to adjust Free tier limits at any time. We will provide reasonable notice of any reduction to existing Free tier benefits.

Your privacy matters to us. Our full Privacy Policy explains in detail what data we collect, how we use it, and your rights. Key points:

• We collect only what is necessary to provide and improve the service
• Your account data is stored securely in Supabase (PostgreSQL with row-level security)
• Payments are handled by Stripe — we never store card numbers or payment credentials
• We send transactional emails (account confirmation, password reset, streak milestones) via Resend
• You can unsubscribe from non-essential emails at any time
• We never sell your personal data to third parties
• EU/EEA/UK users have full GDPR rights including access, correction, erasure, and portability

To exercise your data rights or request account deletion, email privacy@nativspeaker.com.

You agree to indemnify, defend, and hold harmless NativSpeaker and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the service in violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your failure to comply with the terms of service of any third-party platform (TikTok, YouTube, Instagram, etc.) when using those platforms alongside NativSpeaker
• Any content you submit, post, or transmit through the service
• Your violation of any applicable law or regulation

NativSpeaker respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws. We process only publicly available caption text for educational purposes and do not host video or audio content.

If you believe that any content accessible through NativSpeaker infringes your copyright, please send a written notice to legal@nativspeaker.com containing:

• Your full name and contact information
• Identification of the copyrighted work you believe has been infringed
• Identification of the specific content you are requesting be removed
• A statement that you have a good faith belief that the use is not authorised
• A statement under penalty of perjury that the information is accurate and you are the rights holder or authorised to act on their behalf
• Your physical or electronic signature

We will respond to valid DMCA notices within 5 business days. We also respond to valid legal requests from law enforcement and government authorities in accordance with applicable law.

These Terms are governed by and construed in accordance with applicable laws. As NativSpeaker is operated by an individual developer based in Cameroon, formal legal jurisdiction is limited. We are committed to resolving disputes fairly and in good faith.

We aim to respond to all enquiries within 5 business days.

We may revise these Terms at any time. For material changes, we will:

• Email registered users at least 30 days before the changes take effect
• Display a prominent notice on the NativSpeaker website
• Update the "Last updated" date at the top of this page

Your continued use of NativSpeaker after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the service before the effective date.
